The Right to a Fair Hearing: O’Hanlon v District Court

Background

Sean O’Hanlon was charged with stealing two cans of Coca Cola worth less than €4. At Dundalk District Court on 22 July 2026, he was not legally represented at the hearing, due to difficulties arising from an ongoing solicitors’ strike.

His bail was refused in relation to the new charge, and his existing bail was also revoked.

O’Hanlon was subsequently represented in the High Court by MKS Solicitors, with Mariah Donnelly acting on his behalf, alongside counsel.

Legal Issue

O’Hanlon argued that the District Court proceedings were fundamentally unfair because:

• He did not have legal representation at the relevant hearing.
• He was not given adequate notice of the Garda objection to bail.
• He was denied the opportunity to cross-examine a Garda witness.
• His existing bail was revoked without an adequate opportunity to respond.

High Court Decision

Mr Justice Garrett Simons found that the District Court hearing had been fundamentally unfair.

The High Court held that O’Hanlon had not been given the procedural protections required in a bail hearing, particularly the opportunity to cross-examine the Garda witness and respond to the revocation of his existing bail.

The court therefore ordered his immediate release from Cloverhill Prison on bail.
